Subrogation
New England Investigation Services subrogation, or third party investigations are an integral part of our AOE/COE investigations focused however, on identifying the negligent third party. We recognize that it is critical that the claims examiner and the investigator be cognizant of the potential for subrogation and that once it appears that a third party might be responsible for a loss, the claim should be prepared and adjusted with subrogation in mind.
We are keenly aware that the burden of determining subrogation potential is only a part of, and often at the bottom of a long list of claims examiners responsibilities; including verifying coverage, determining compensation, approving payments and completing reports. We also recognize that the subrogation potential can be easily overlooked given the number of cases that are handled by a claims examiner each day. This, compounded by the fact only about 2% of all workers compensation cases have subrogation potential often leads to missed potential cases or time wasted pursuing investigations with little or no subrogation potential.
There is a small window of opportunity to collect evidence necessary to support and prevail in a subrogation case and that evidence can disappear very rapidly. There is no turning back on missed subrogation. The use of automated subrogation detection technology exists and can accurately identify subrogation potential quickly and effectively.
